Terms of Service

By accessing and using Compliance Pro ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. These Terms of Service apply to all users of the Platform, including clients, auditors, and administrators.

Compliance Pro is a cloud-based platform designed to help organizations manage their ISO27001 compliance requirements. Our services include:

• Evidence management and documentation storage
• Audit assignment and tracking
• Compliance assessment tools
• Reporting and analytics
• Secure collaboration between clients and auditors

To access our Platform, you must create an account. You are responsible for:

• Providing accurate and complete registration information
• Maintaining the security of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use
• Maintaining current contact information

Account Types:

• Client Users: Responsible for uploading evidence and maintaining compliance records
• Auditors: Responsible for conducting fair and professional assessments
• Super Administrators: Responsible for platform management and user oversight

You agree not to use the Platform to:

• Upload false, misleading, or fraudulent compliance documentation
• Access data belonging to other organizations without authorization
• Attempt to compromise platform security or user privacy
• Use the Platform for any illegal or unauthorized purpose
• Interfere with or disrupt the integrity or performance of the Platform
• Reverse engineer, decompile, or attempt to extract source code
• Share your account credentials with unauthorized individuals

Your Data: You retain ownership of all data, documents, and content you upload to the Platform. We do not claim ownership of your compliance documentation or business information.

Platform Data: We retain ownership of the Platform itself, including all software, analytics, and system-generated insights.

Privacy: Your use of the Platform is also governed by our Privacy Policy, which forms an integral part of these Terms.

We strive to maintain high service availability, but we do not guarantee uninterrupted access. The Platform may be temporarily unavailable due to:

• Scheduled maintenance and updates
• Emergency security measures
• Technical difficulties beyond our control
• Force majeure events

We provide support services as outlined in your service agreement. Support response times may vary based on your subscription tier and the nature of the request.

Subscription Plans: Access to the Platform is provided through subscription plans with different feature sets and pricing.

Payment:

• Subscription fees are billed in advance on a recurring basis
• All fees are non-refundable unless otherwise specified
• Price changes will be communicated with 30 days' notice
• Failure to pay may result in service suspension

The Platform and its original content, features, and functionality are owned by Compliance Pro and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

Limited License: We grant you a limited, non-exclusive, non-transferable license to use the Platform for your compliance management needs, subject to these Terms.

Professional Advice: The Platform provides tools and resources but does not constitute legal, financial, or professional advice. Users should consult qualified professionals for specific compliance guidance.

Limitation of Liability: To the maximum extent permitted by law, Compliance Pro shall not be liable for any indirect, incidental, special, consequential, or punitive damages.

You agree to indemnify and hold harmless Compliance Pro from any claims, damages, or expenses arising from:

• Your use of the Platform
• Your violation of these Terms
• Your violation of any rights of another party
• Any content you submit to the Platform

By You: You may terminate your account at any time by contacting our support team. Upon termination, you will lose access to the Platform and your data.

By Us: We may terminate or suspend your account if you violate these Terms, engage in fraudulent activity, or for other legitimate business reasons.

Data Retention: Upon termination, we will retain your data for a reasonable period to comply with legal obligations and allow for account reactivation.

These Terms are governed by the laws of Australia. Any disputes arising from these Terms or your use of the Platform will be subject to the exclusive jurisdiction of the courts of Victoria, Australia.

Dispute Resolution: We encourage resolving disputes through direct communication. If formal resolution is needed, we prefer mediation before litigation.

We reserve the right to modify these Terms at any time. Changes will be effective when posted on the Platform. We will notify users of material changes through:

• Email notifications to registered users
• Prominent notices within the Platform
• Updates to the "Last Updated" date above

Your continued use of the Platform after changes constitutes acceptance of the new Terms.

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect.
